Privacy policy

This Privacy Policy explains how Chadd Thompson LLC, doing business as Gifted Shades (“Gifted Shades,” “we,” “us,” or “our”), collects, uses, and shares information about you when you visit giftedshades.com (the “Site”), redeem a gift code, or otherwise interact with us.

2. Information we collect

We collect information from two groups of people: recipients who redeem a gift code on the Site, and business customers (the companies that purchase code programs from us).

From recipients

Order information. When you redeem a code and place an order, we (and our e-commerce provider, Shopify) collect your name, shipping address, email address, and any other information you provide at checkout.
Code information. The gift code you enter, the program it belongs to, and timestamps for when the code was issued, redeemed, and expires.
Device and usage data. When you visit the Site, our hosting and platform providers automatically receive standard log information including IP address, browser type, referring URL, pages viewed, and timestamps. This is used for security, fraud prevention, and basic site operations.
Cookies and similar technologies. The Site uses cookies set by Shopify to operate the cart, secure your session, and complete checkout. We do not currently run third-party advertising pixels, social-media trackers, or third-party analytics on the Site.

From business customers

Contact and account information. Company name, the name and email of your point of contact, billing address, and any information you provide to us when discussing or signing up for a code program.
Program information. The codes we issue on your behalf, the recipients you ask us to deliver them to (if applicable), and reporting on redemption activity.

3. How we use your information

We use the information we collect to:

Process and fulfill orders, including shipping product to you;
Verify, validate, and track the use of gift codes;
Provide customer support and respond to your inquiries;
Send transactional messages such as order confirmations and shipping updates;
Send promotional materials to existing business customers about new programs, products, and offers (you can opt out at any time — see Section 7);
Detect, investigate, and prevent fraudulent or abusive activity, including misuse of codes;
Comply with our legal obligations and enforce our agreements.

We do not sell your personal information, and we do not send marketing emails to gift recipients (only to business customers who have purchased programs from us).

4. How we share your information

We share your information only with the parties needed to operate our service:

Shopify, Inc. — our e-commerce platform, which hosts the Site, processes payments, and stores order data;
Shipping carriers — to deliver your order;
Service providers we use for hosting, security, and customer support (currently including Cloudflare for landing-page hosting);
Business customers, in aggregated or anonymized form, for reporting on the redemption of their programs (we do not share recipients’ personal contact information with the businesses that issued the codes);
Legal authorities, when we are required to disclose information to comply with a subpoena, court order, or other legal process, or to protect our rights, property, or safety, or that of others;
In a business transfer, such as a merger, acquisition, or sale of assets, in which case the recipient of your information will be bound by the terms of this Privacy Policy.

5. Data retention

We retain order information for as long as required to fulfill the order, support customer service, and comply with our legal and tax obligations (typically a minimum of seven years for transactional records). Code data is retained for the life of the program plus a reasonable period for audit and reporting. Marketing contact data for business customers is retained until you opt out or request deletion.

6. Your rights and choices

You may:

Request access to the personal information we hold about you;
Request that we correct inaccurate or incomplete information;
Request that we delete personal information we hold about you, subject to our legal and operational retention obligations;
Opt out of promotional emails by clicking the unsubscribe link in any marketing email or by emailing us at hello@giftedshades.com.

7. California residents (CCPA / CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

Right to know what categories of personal information we have collected about you, the sources, the purposes for collection, and the categories of third parties with whom we share it. The categories we collect are described in Section 2 above.
Right to delete personal information we have collected from you, subject to our legal and operational retention exceptions.
Right to correct inaccurate personal information we have about you.
Right to opt out of the sale or sharing of personal information. We do not sell or share personal information for cross-context behavioral advertising.
Right to non-discrimination for exercising your privacy rights.

8. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Gift codes are intended for use by adults. If you believe a child under 13 has provided us with personal information, please contact us at hello@giftedshades.com and we will delete it.

9. Geographic scope

The Site and our products are intended for customers and recipients located in the United States. We do not currently market to or knowingly accept orders from outside the United States. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States.

10. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information. Payment processing is handled by Shopify Payments and other PCI-compliant processors; we do not store full payment card numbers on our own systems. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

11. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will post the revised policy on this page and update the “Effective date” above. If the changes are material, we will provide additional notice (such as by email to business customers).
